If you're buying OEM gummy mold services, you're asking a shop to build your platinum RTV cavity tray to your print, not a catalog bear with a sticker.

The OEM product is the mold: master, mold box, RTV pour, jacket, array, dump features, and a food-contact file under 21 CFR 177.2600 extractives and/or LFGB. The recipe stays with you or your co-packer. Piece-weight is specified as cavity volume. This isn't a private-label gummy contract.
Mold OEM isn't gummy private label
OEM mold: you bring cavity CAD, pitch, dump, and markets; we tool the master and pour the tray. ODM-ish catalog: we already have a bear array; you buy it — fine for tests, weak for a branded vitamin piece. Private-label gummies: a co-packer makes candy — different vendor class.
If you need a mascot at 2.2 ml on a named depositor, you want OEM mold services. If you need 5,000 finished bottles, you want a co-packer, who may then OEM the tray from a shop like ours. We'll put your tool number and revision on the master, not a fake factory name.
Paying a tooling charge doesn't, by itself, give you unrestricted transfer rights. Write customer-owned, supplier-owned, shared jacket plus customer faces, amortized, or supplier-financed on the PO. A shop-owned master isn't automatically a rental.
Drawings, masters, ownership
Send STEP of the cavity, 2D of the tray envelope, pin pattern, and dump motion. Artwork at a resolution that can become a radiused relief. A photo of a competitor bear isn't a drawing.
Who owns the master, the jacket, and recast rights has to be in the PO. Customer-owned master stored at the shop, shop-owned master amortized into the tray price, customer faces in a shop jacket — all happen. IP of the mascot is yours if you supplied it. A shop catalog bear is theirs. Don't mix those on one insert set without a sentence.
Masters are SLA or machined patterns for platinum RTV. Dirty resin inhibits platinum — degrease and barrier. Production is still an RTV tray against that master, not an LSR injection tool unless you separately ordered molded *parts*.
Sampling path: one-up or two-cavity platinum RTV, plant dump in real slurry, production master at real pitch with jacket, first-article envelope/pitch/volume/flash/flatness/wash, then 21 CFR 177.2600 extractives and/or LFGB/BfR XV on the article. We don't supply a vitamin premix COA or a cannabinoid assay. Color, dual-pour, and insert systems are part of identity; changing any of them is a new article.
NDA if the art is unreleased, tool number not a trade-show photo, face libraries stored so SKU B can't ship in SKU A's box. HS (4016.99 / 3926.90) is a forwarder conversation, not an IP strategy.
Common mix-up: I paid for tooling, so I own the master
A lot of RFQs treat a tooling charge as unrestricted ownership. In the shop that usually means you'll argue later about who can recast, who can cut a second master, and whether the jacket stays. If the PO is silent, don't assume. Customer-owned masters are common for branded mascots. Shop-owned masters are common for generic cups. Write recast rights either way.
Handoff is done when the plant can deposit, dump, and wash without calling about pitch. Pack so cavities don't crease. Include drawing and volume, Shore, RTV grade, post-cure, jacket construction, food-contact reports, wash limits you actually tested, spare count, recast terms. If the co-packer wants to change dump from flex to knock, that's a design change.
Revision control: cavity volume v2 that gained 0.15 ml is a new face or a master recut. Label revision on a non-food tab. If several brands share a co-packer, each mascot is still a tool number. "Similar bear" isn't 2.2 ml.
What to ask when you're buying OEM
- Who owns the master, the jacket, and recast rights — customer, shop, shared, amortized, supplier-financed?
- Sampling path: one-up in our slurry before the production array?
- 177.2600 extractives and/or LFGB on this construction, this color?
- Spare-tray count as a number, not a fake dump life?
- Storage fees if the master sits idle, and who pays a CAD revision after first article?
- NDA and no trade-show use of our cavity without written permission?
Example
A typical OEM packet is a 24-cavity 2.0 ml vitamin oval, Shore 25A platinum RTV, aluminum jacket, customer-owned CNC master stored at the shop, two spare trays, 177.2600 extractives plus LFGB on the production article. Recast of the face is a line item.
When OEM mold services are the wrong vendor
If you need 5,000 bottles of finished gummies, you want a co-packer, not a tray OEM. If you only need a catalog bear to test a depositor, an ODM array may be enough. If you want us to run 21 CFR 111 or private-label candy, that's a different hall. Paying a tooling charge still isn't unrestricted ownership unless the PO says customer-owned / shop-owned / shared / amortized / supplier-financed.

FAQ
Can an OEM mold shop also make the gummies? Some groups have both halls. Most RTV mold shops don't. Treat mold OEM and gummy co-pack as separate qualifications. Food-contact of the tray isn't process validation of the candy.
Who owns the master in a typical OEM mold PO? Whatever the PO says. If it's silent, you'll argue later. Customer-owned masters are common for branded mascots. Shop-owned masters are common for generic cups. Write jacket and recast rights too.
Does OEM include 21 CFR 111 supplement GMP? No. OEM of the tray includes rubber food-contact (177.2600 extractives / LFGB) and dimensional first article. Supplement GMP is the plant that deposits the gummy.
How do we OEM a family of seasonal shapes? One jacket envelope, face sets or separate trays at the same pitch and target volume. Each touching face is an article. Lock dump motion so the station doesn't change every holiday.
What if our only file is a PNG of a bear? That's artwork intake, not OEM-ready CAD. Budget a model: volume, draft, ear roots. A shop that cuts a master from a PNG without a volume freeze isn't doing OEM, it's guessing.
